Applying for a residence permit for Swiss nationals

Swiss nationals do not require a residence permit.
To enter the federal territory

  • they require a valid identity card or passport and
  • must register with the relevant registration office if they wish to remain resident in Germany.

If they apply for a residence permit, one can be issued to them. However, this is not mandatory. You must submit the application to the relevant immigration authority.

Family members who claim a right of residence on the basis of the EU-Switzerland Agreement must report their residence to the immigration authority.

Note: If family members do not report their residence, this is an administrative offence.

Prerequisite

  • You are a Swiss citizen or
  • You are married to a Swiss citizen or are related in the ascending or descending line.

Procedure

If you wish to apply for a residence permit, you must do so at the Foreigners' Registration Office, providing the information listed below. The following information must also be provided by family members of Swiss nationals who wish to derive a right of residence:

  • Name (also possible previous names)
  • First names
  • Date and place of birth
  • Your address in Germany and former addresses
  • former and current nationalities
  • Purpose, start and duration of residence
  • if you derive your right of residence from another person to whom you are married or related: Details of this relationship

The foreigners authority will check whether you fulfil the requirements for the right of free movement. After a positive examination and payment of the fee, you will receive a residence permit.

The residence permit is issued in the form of a cheque card with additional electronic functions. You can choose whether you wish to receive the residence permit in the form of a cheque card with additional electronic functions or in the previous form on a form.
